We make no express or implied warranties of any kind regarding the products sold, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

1.3 Limitation of Liability: To the fullest extent permitted by law, M-Quality Furniture, its directors, employees, and representatives aren't liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, arising from or in connection with the products sold, even if M-Quality Furniture has been advised of the possibility of such damages. Your sole and exclusive remedy for any dissatisfaction with our products is limited to the return and refund policy outlined in Section 4.

  1. Delivery Services

2.1 Delivery Scope and Confirmation: We aim to deliver your purchased items directly to your specified premises or a designated delivery point mutually agreed upon during order placement and confirmation. Before dispatching your order, we'll contact you on the agreed delivery date to re-confirm the delivery details and address. Dispatch will only proceed upon your explicit confirmation.

2.2 Unattended Deliveries: Should you request your merchandise be left unattended at the delivery location, M-Quality Furniture explicitly disclaims all responsibility for any subsequent loss, damage, or theft that may occur. By making such a request, you assume all associated risks.

2.3 Delays Beyond Our Control: We aren't liable for any delays in delivery or failure to deliver caused by circumstances beyond our reasonable control. These circumstances may include, but aren't limited to, natural disasters, strikes, civil unrest, acts of terrorism, governmental regulations, transportation disruptions, or unforeseen operational issues. In such events, we'll endeavor to inform you promptly and reschedule delivery as soon as feasible.

2.4 Change of Delivery Instructions: It's your responsibility to promptly notify us of any changes to your delivery instructions or circumstances that may affect delivery. Failure to do so may result in delays or additional charges.

2.5 Acceptance of Goods at Delivery: Upon delivery, you or your authorized representative will be asked to sign a Delivery Note. Your signature signifies that the goods have been delivered in good and proper condition, free from visible damage, and that the order is approved. We'll reasonably assume that anyone at the delivery address who receives the goods is authorized by you to do so and to provide the necessary acknowledgement.

2.6 Postponing Delivery: If you need to postpone your scheduled delivery, please notify us at least 24 hours in advance of the agreed delivery date. We'll then work with you to reschedule delivery to a mutually convenient date.

2.7 Special Delivery Requirements and Accessibility: Our delivery drivers are generally instructed to deliver your purchase to the main entrance of your premises. To prevent unforeseen issues, it's crucial that you inform us at the time of purchase of any special delivery requirements or challenges related to accessibility (e.g., narrow doorways, tight turns, stairs, absence of lifts for upper floors). It's solely your responsibility to ensure the purchased goods can be safely and adequately delivered to your desired room or location within your premises. Delivery beyond the main entrance will only be attempted at your explicit request and entirely at your own risk, with M-Quality Furniture assuming no liability for any damage to your property or the goods during such maneuvers.

2.8 Delivery Timelines: Typically, deliveries are completed within two (2) or more weeks from the date of purchase. This timeframe can vary depending on the complexity of the item ordered and the availability of the specific type of wood selected. We'll provide you with an estimated delivery window at the time of purchase.

2.9 Delivery Charges and Additional Fees:

  • Standard Delivery Charges: All standard delivery charges are fixed as quoted at the time of purchase and will be included in your total at checkout.
  • Additional Charges: Additional charges may apply in specific circumstances where normal site access is unavailable, for instance, if deliveries require specialized equipment such as hoisting mechanisms, or if changes to delivery arrangements are communicated to us less than 24 hours prior to the scheduled delivery time. Any such additional charges will be communicated to you and must be paid prior to the completion of delivery.

2.10 Dynamic Delivery Fee Structure (Nairobi Area): Our delivery charges are dynamic, taking into account the delivery location, chosen delivery method, and the total value of your order.

  • Free Delivery: All deliveries within the Nairobi area are free for any single order with a total purchase exceeding KES 120,000.00.
  • Charges for Orders Below KES 120,000.00 (Nairobi Area): For orders below KES 120,000.00, please refer to the following chart for applicable delivery fees based on area:

  1. Payment Terms & Methods

3.1 Pricing and VAT: All prices displayed on our items are quoted in Kenya Shillings (KES) and are exclusive of Value Added Tax (VAT) unless expressly stated. VAT will be added to your total purchase amount where applicable.

3.2 Full Payment Required at Checkout (Online Orders): For all orders placed through our website, full payment, including the product price and all applicable delivery charges, is required at the time of checkout. Your order won't be processed or confirmed until full payment has been successfully completed via the chosen method at checkout.

3.3 Accepted Payment Methods (Online Checkout Only): Payments for all orders placed through our website can only be made using the payment methods presented and available on the secure checkout page. This includes debit/credit card payments (Visa, MasterCard) and M-Pesa options, facilitated securely via our payment gateway partner, Pesapal. No other payment methods, including direct bank transfers, personal cheques, banker's drafts, or cash on delivery, are accepted for website orders.

3.4 Proof of Identity and Address: To safeguard your security and prevent potential fraud, we reserve the right to request proof of identity for all purchases. If your delivery address differs from your billing address, or to facilitate necessary security checks, you may also be required to provide proof of address.

3.5 Payment Clearance: For any payments that require clearance (e.g., via our payment gateway), your order will only be processed and dispatched once funds have fully cleared in our account and been confirmed by our payment processor.

  1. Refunds & Returns Policy

At M-Quality Furniture, your satisfaction is paramount. Please carefully review our comprehensive refund and return policy for products that have already been delivered:

4.1 Customer Inspection and Acceptance at Delivery: It's mandatory for customers to thoroughly inspect and approve their order at the time of delivery. Your signature on the delivery note serves as conclusive confirmation of your acceptance of the product(s) in good and undamaged condition.

4.2 Notification of Return Intent: You must communicate your intention to return an item within 48 hours of receiving your delivery. Failure to notify us within this timeframe may result in the refusal of your return request.

4.3 Eligibility for Returns and Refunds: Returns and refunds will be processed within 24 to 48 hours of your initial communication, subject to the following strict criteria being met:

  • Identified Faults/Defects: This includes any manufacturing faults or inherent defects that may have been genuinely overlooked during the initial delivery inspection. Such faults must not be a result of misuse, abuse, or neglect by the customer.
  • Product Specifications Not Matching Ordered Product: If the delivered item demonstrably doesn't match the specifications (e.g., color, size, material, or design) of the product you explicitly ordered.
  • Lack of Fit for Intended Purpose: If the product is demonstrably unsuitable for its intended and standard purpose, and this unsuitability wasn't communicated or understood by you prior to the purchase. This doesn't apply to situations where the product is simply not suitable for your specific unique requirements if those requirements weren't clearly communicated and agreed upon before purchase.

4.4 Return and Refund Process: To initiate a return or refund, please follow these steps:

  2. Describe Reason for Return: Clearly and concisely describe the reason for your return, referencing one of the eligibility criteria listed above. Providing clear photos or videos of the issue can significantly help expedite the assessment process.

  3. Return Acceptance and Instructions: Once your return request has been assessed and provisionally accepted, we'll provide you with detailed instructions for the return of the item to our workshop.

  4. Customer Covers Return Costs: Unless otherwise agreed upon in writing by M-Quality Furniture, customers are responsible for covering all costs associated with returning the item to our workshop located in Kahawa Sukari.

  5. Assessment and Resolution: Upon the safe receipt and thorough assessment of the returned item at our workshop, if the fault or damage is confirmed to meet the eligibility criteria and can't be repaired to a satisfactory standard, then:

    • The furniture will be replaced with an identical item if it's currently in stock.
    • Alternatively, if a replacement isn't available, a credit voucher for a similar value will be issued, which can be redeemed against future purchases from M-Quality Furniture.
    • Important Exclusion: This policy will not apply to the extent that the fault, defect, or damage is directly caused by abuse, misuse, negligence, accident, improper handling, or lack of care by the customer.

4.5 Important Considerations:

  • Mattress Purchases: When purchasing a mattress, it's imperative that you verify the mattress size (length, width, and height) against your bed frame dimensions before finalizing the purchase. Due to hygiene and custom order considerations, cancellations or returns on special order mattresses can't be entertained once the order is confirmed.
  • Sofa Dimensions: The precise dimensions of all our sofas are clearly displayed on their respective price stands. It's your sole responsibility to take note of these dimensions and ensure they're suitable for your space, including doorways, stairwells, and lifts, before confirming your purchase. We regret that we can't accept returns of sofas if they don't fit through the doors or lifts of your building due to your failure to check dimensions beforehand.
  • Cancellations: Order cancellations must be communicated directly to the point of purchase no later than three (3) working days prior to the scheduled delivery date. We won't accept cancellations after this specified timeframe. Accepted cancellations are subject to a 10% deduction from the total order amount to cover administrative and processing costs. Please note that delivery charges won't be refunded if we've already attempted to deliver goods.
  • Change of Mind: Please choose your items carefully. We generally don't offer refunds or exchanges simply because you change your mind or make an incorrect decision. Exchanges and refunds will only be granted where goods are demonstrably faulty and can't be replaced or rectified, are wrongly described, differ significantly from the sample shown to you, or don't perform their intended standard function as advertised.
